Student Visa Cancelled in Australia: Reasons, Notice and Next Steps

Government sources retrieved 18 and 19 October 2026

A student visa can be cancelled if you are no longer enrolled in a registered course, and once you finish your course you have 3 months to leave Australia or apply for another visa before the Department may cancel it.

Check whether the document is a notice proposing cancellation or a decision cancelling the visa, then record its date and any response or review instructions.

The Home Affairs page on cancelling a visa explains these enrolment and course-completion grounds.

Document received What to identify First action
Proposed cancellation notice The allegation and stated response date Assemble a response and supporting records.
Cancellation decision The decision date and stated review instructions Seek prompt legal advice about status and review.
Refusal decision The application refused and stated review instructions Treat the refusal separately from a cancellation.

Why is a student visa cancelled?

  1. No longer enrolled. Home Affairs states that a student visa may be cancelled if the holder is no longer enrolled in a registered course.
  2. Course finished. Home Affairs states that after completing the course, the holder has 3 months to leave Australia or apply for another visa before the Department may cancel the visa.
  3. New course ends earlier. Home Affairs states that, after changing courses to a new principal course that ends earlier, the holder has 28 days after completing it to leave Australia or apply for another visa.
  4. Gap between packaged courses. Home Affairs states that a gap of more than 2 months between packaged courses can lead to cancellation, other than a gap between academic years.
  5. Other visa condition breached. Home Affairs states that breaching other student visa conditions can also lead to cancellation.

Home Affairs states that before cancelling, the Department considers whether the holder finished early legitimately, their academic record and whether re-enrolment is reasonable.

Home Affairs states that from 2 October 2026 most Student visa holders can no longer lodge a further Student visa application in Australia under the Home Affairs student visa application rule changes, which makes the date on a notice more important.

What does a cancellation notice mean?

Home Affairs states that, for a person in Australia, the Department will usually explain that it intends to consider cancellation and give the person a chance to put forward reasons not to cancel. A proposed cancellation notice is not the same as a decision cancelling the visa.

The following are preparation material, not a list of required documents:

  • The notice, including its date, allegations and response instructions.
  • Enrolment records, relating to the course or course changes raised in the notice.
  • Academic record, relevant to course progress or completion.
  • Relevant correspondence, concerning the enrolment, course completion or alleged breach.

What happens after cancellation?

Question What Home Affairs states
Can future visa applications be affected? Cancellation can affect future visa applications.
Can family members’ visas be affected? Cancellation can affect family members’ visas.
What happens to lawful stay? Cancelling a visa does not bring a bridging visa into effect, so check whether another visa applies.

The decision document states any review instructions, so follow those instructions rather than relying on a general deadline.

A cancelled visa and an expired visa are different, but both can leave a person unlawful under the circumstances described by Home Affairs, which is relevant when considering what happens if you overstay a visa.

How many hours can a student visa holder work?

Home Affairs states that a student visa holder can work up to 48 hours a fortnight when the course is in session.

Home Affairs identifies breaching a visa condition as a ground for cancellation, so working beyond a visa’s permitted hours can put the visa at risk.

Student visa refused

Decision What it is
Refusal A decision not to grant the visa applied for.
Cancellation A decision cancelling a visa that has already been granted.

Treat the document according to the decision it records, rather than assuming that refusal and cancellation have the same effect or review instructions.

If review fails: ministerial intervention

Home Affairs states that ministerial intervention requires a tribunal decision first.

Home Affairs states that the Minister is not required to consider a request and no timeframe applies.

Home Affairs states that only requests meeting the Ministerial Instructions are referred to the Minister.

Ministerial intervention is separate from tribunal and court review.
